What is the Uniform Bar Exam (UBE)?
The Uniform Bar Exam is composed of the Multistate bar exam (MBE); the Multistate Performance Test (MPTs), which do not cover a specific area of law–rather, they test lawyerly skills; and also an essay portion, the Multistate Essay Exam (MEE). Below are the tested subjects on the MEE portion of the Uniform Bar Exam. Note: the Uniform Bar Exam tests the same subjects that the Multistate Essay Exam (MEE) tests. More on the UBE HERE.

For the essay portion, you will have six questions to answer in three hours (so 30 minutes/question).

- Civil Procedure: This topic was most recently tested in July 2023. Given its frequency, it will likely be tested in July 2024. Some Civil Procedure issues that could be tested include Personal Jurisdiction, Venue, Service of Process, Pleadings, Discovery, and Claim preclusion. - Constitutional Law: This topic was last tested in October 2020! It should be tested in July 2024, perhaps combined with Civil Procedure as was the case in July 2019. Constitutional Law essays usually focus on the Dormant Commerce Clause, sovereign immunity, regulatory takings, and the various free speech tests under the First Amendment. - Contracts: Although it was tested in February 2024, it has been tested back-to-back in previous year so that it wouldn’t be a surprise to see this in July 2024 again. Topics include contract formation and substantial performance. Check our Contracts outline here.
- Criminal Law: Last tested in February 2022, this makes it an ideal candidate for July 2024. Some popular issues include accomplice liability, homicide, insanity as a defense, attempt and defenses to attempt, and receiving stolen goods. Criminal Law outline.
- Criminal Procedure: While it was tested in February 2024, it is often combined with Criminal Law so that it could be an ideal candidate for the July 2024 Bar Exam. Criminal Procedure outline.
- Evidence: This topic is often combined with Criminal Law and is a favorite of the Examiners. Again, an ideal candidate. Some Evidence issues that are ripe for testing include Hearsay, Impeachment, Lay witnesses, confrontation clause, and policy exclusions. Evidence outline.

- Objective Memorandum: The objective memorandum has appeared on 32 out of the 38 MPT exams since July 2006, or 84% of the time. This is one of the most highly tested MPT task and an ideal candidate for the July 2024 Bar Exam.
- Persuasive Brief: This is the second most tested MPT task, appearing on the MPT 50% of the time since July 2006. It may be ripe for testing on the July 2024 MPT.
Note: You should take the time to review all of the commonly tested tasks on the MPT (objective memorandum, persuasive brief, demand letter, and opinion letter).
