2020 New York Bar Exam: Third Application Period Open

While the global pandemic has affected prospective bar candidates in jurisdictions across the country, the impact in New York has been especially severe.  As a result, seating capacity for the September 9-10, 2020 bar exam has been sharply limited, and the New York State Board of Law Examiners (“the Board”) announced that it will not be able to seat all candidates who wish to take the exam in New York.

If you are not aware of the change: please do not show up at the Exam Center in July as the NY Bar Exam has officially been rescheduled for September 9-10. The New York Court of Appeals had initially announced on March 27, 2020 that the Bar Exam will not be administered on July 28-29, 2020 due to COVID-19 concerns.

As previously announced, the application process for the September bar exam is proceeding on a rolling basis as space permits. You can read more about Bar Exam Updates on the official Board’s Website, accessible here. The initial application periods, which ran from May 5 through May 15 and from June 2 through June 12, are now closed.  A third application period has now been opened until June 16. 

Applications are now accepted from any candidate who graduated with an LL.M. degree from an ABA-accredited law school located outside of New York, and who has not previously sat for a bar exam in any U.S. jurisdiction. 

The Board explains that candidates who were required to obtain an LL.M. degree in order to qualify to sit for the bar exam and who have not previously received a preliminary determination of eligibility following review of their foreign credentials will not be permitted to sit for the September exam.  The application period will close on Tuesday, June 16 at 5:00 P.M. Eastern Time. Please note that, at this time, seating cannot be guaranteed to candidates who register during this application period.  After the application period closes, the Board will assess available seating in light of existing health and safety guidance, and applicants will be notified whether or not they will be seated for the exam.

The Court of Appeals and the Board are working together to maximize seating and ensure that the health and safety of all participants remain a top priority. Given the constraints caused by the public health crisis, candidates are strongly urged to consider sitting for the UBE at a later date or in other jurisdictions that may be better positioned to accommodate test-takers.
